Personnel Hygiene Services Limited (PHS) / the “Company” / “We” / “Us” / “Our”) is fully committed to providing all of Our customers with the best possible customer journey and service, quality products and lowest prices.  We want You to buy from Us repeatedly. 

References to "You"' or the "Customer" shall be references to be person or organisation placing the order with Us mainly for the purpose of their trade or business.   If You are a consumer then, whilst these terms will apply to You, the terms in the box below will take precedence over the remainder of the terms.    

PHS Shop has been created to provide a single unified experience for our customers,  

to simplify the entire consumable ordering process from start to finish. It offers an easy,  

intuitive way to place orders, track progress and manage Customer requirements all in one place 

1.     General 

 Acceptance by Us of an order for the supply of goods, irrespective of how it is received will be subject to these terms and conditions.   

These terms apply to all products that are purchased from Us. 

Please read these terms carefully before You submit Your order to Us. These terms tell You who We are, how We will provide products to You, how You and We may change or end the contract, what to do if there is a problem and other important information.  If You think that there is a mistake in these terms, please contact Us immediately to discuss.

ADDITIONAL CONSUMER TERMS (not applicable to business customers) 

·     Payment for any goods ordered must be paid for at the
time You place the order.  

  • For all delivery information please see clause 5 in the full terms below which sets out all the information about deliveries. Please be aware that if You are not in when We attempt to deliver the goods then additional delivery charges may apply for re-delivery (see clause 5 of the main terms below). 
  • If We cannot accept Your Order, We will inform You on this in writing and You will not be charged for the goods.  This might be because the product is out of stock, because of unexpected limits on Our resources which We could not reasonably plan for, because We have identified an error in the price or description of the product or because We are unable to meet a delivery deadline You have specified.  
  • If You change Your mind about Your Order, please contact Us.  We will let You know if the change is possible. If it is possible We will let You know about any changes to the price of the product, the timing of supply or anything else which would be necessary because of Your requested change and ask You to confirm whether You wish to go ahead with the change. If We cannot make the change or the consequences of making the change are unacceptable to You, then You may want to end the contract.  
  • You can always end Your contract with Us, but Your rights will depend on what You have bought, whether there is anything wrong with it, how We are performing and when You decide to end the contract: 
  • If what You have bought is faulty or misdescribed, You may have a legal right to end the contract (or to get the product repaired or replaced or a service re-performed or to get some or all of Your money back) – see below for further information; 
  • If You want to end the contract because of something We have done or have told You We are going to do, then please contact Us and We will refund You in full. 
  • If You have just changed Your mind about the product, then You have a legal right to change Your mind and get a refund if You are within the cooling-off period of 14 days from Your Order, but this may be subject to deductions and You will have to pay the costs of return of any goods; 
  • In all other cases (if We are not at fault and there is no right to change Your mind), You can still end the contract before it is completed, but You may have to pay Us compensation.  A contract for goods is completed when the goods are delivered and paid for.  If You want to end a contract before it is completed where We are not at fault and You have not changed Your mind, just contact Us to let Us know. The contract will end immediately, and We will refund any sums paid by You for goods not provided but We may deduct from that refund reasonable compensation for the net costs We will incur as a result of Your ending the contract. 
  • You will not have a right to return any goods which are sealed for health protection or hygiene purposes, and once these have been unsealed after You receive them, unless they are faulty.

If Your product is goods, the Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality.  During the expected lifespan of Your product Your legal rights entitle You to the following: 

  • Up to 30 days: if Your goods are faulty, then You can get an immediate refund.   
  • Up to six months: if Your goods can't be repaired or replaced, then You're entitled to a full refund, in most cases.   
  • Up to six years: if Your goods do not last a reasonable length of time, You may be entitled to some money back.    

  

2.     Orders 

Acceptance. By placing an Order for our products, You warrant that You are legal capable of entering into a contract with Us. No order submitted by You shall be deemed to have been accepted until confirmed in writing by the Company.  An Order acknowledgement of Your online order constitutes receipt of an offer of a contract and does not constitute acceptance of such order. Our acceptance of Your order will take place when We email You to accept it, at which point a contract will come into existence between You and Us.   We will assign an order number to Your order and tell You what it is when We accept Your order. It will help Us if You can tell Us the order number whenever You contact Us about Your order.   

Our website is intended for the promotion of Our products in the UK with delivery to an address in the UK mainland. Delivery to other UK locations, for example, IOM, NI.CI and Western Isles of Scotland are excluded from standard delivery and will incur a higher delivery charge, and such orders can only be placed offline. We do not accept orders for delivery to addresses outside the UK.  

Descriptions.  Due to continual design and manufacturing improvements strict accuracy of descriptions, specifications, colours, sizes, capacities and illustrations cannot be guaranteed but will not vary significantly.   We will inform You in writing of any significant change in specification.  In the event of a specification alteration, notification will be made prior to despatch, and You will have the right to cancel at that point.  Product weights are approximate and any stated load capacities are for evenly distributed loads and must not be exceeded.  

We will confirm acceptance of Your order during normal working hours (Monday-Friday 08:30-17:30) with a confirmed cost and estimated delivery date.  If this is not acceptable, We will try to resolve any issues.  If We cannot resolve any issues, You have the right to cancel Your order without charge prior to despatch (unless the products are being made to order) and receive a full refund.  

If We cannot accept Your order.   If We are unable to accept Your order, We will inform You of this and will not charge You for the product.  This might be because the product is out of stock, because of unexpected limits on Our resources which We could not reasonably plan for, because We have identified an error in the price or description of the product or because We are unable to meet a delivery deadline You have specified.   

3.  Our products and the product descriptions 

Photographs on Our website are provided to assist You in identifying the products You require and are for illustrative purposes only.  We have made every effort to ensure that the digital representations are as accurate as possible, but please be aware that some colour variation may exist between the colour displayed on Your monitor and the actual colour of the item in question.  As a result of resizing product photography, the items may appear larger or smaller than the actual size.  We would always encourage the use of the specific product dimensions or capacity to gauge the actual size of a product, if unsure, please contact us on our website and Our product sales team for clarity We will be happy to provide any information that is not displayed on Our website prior to purchase. 

Product packaging may vary.  The packaging of the products may vary from that shown in images on Our website.  

Product Changes.  We reserve the right to make changes to the products if necessary to comply with any relevant laws or regulatory requirements or if the amendment will not materially affect the nature or quality of the products, and We shall notify You of any such changes.  

4.     Pricing & Payment 

Price for the Products. Unless otherwise specified, Our prices are given in sterling and are exclusive of VAT and carriage, where applicable, (please see Delivery Information for carriage charges).  The price of the product will be the price indicated on the order page when You have placed Your order, or if no price is quoted, the price set out in Our published price list.  Whilst We take all reasonable care to ensure prices shown online and in Our email campaigns etc are correct, We cannot guarantee this.  Please see section 'What happens if We got the price wrong' below for what happens if We discover an error in the price of the product You order.  

We will pass on changes in the rate of VAT.  If the rate of VAT changes between Your order date and the date We supply the product, We will adjust the rate of VAT that You pay, unless You have already paid for the product in full before the change in the rate of VAT takes effect.  

What happens if We got the price wrong. It is always possible that, despite Our best efforts, some of the products We sell may be incorrectly priced. We will normally check prices before accepting Your order so that, where the product's correct price at Your order date is less than Our stated price at Your order date, We will charge the lower amount. If the product's correct price at Your order date is higher than the price stated to You, We will contact You for Your instructions before We accept Your order.  If We accept and process Your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by You as a mispricing, We may end the contract, refund You any sums You have paid and require the return of any products provided to You. 

When You must pay and how You must pay.  We accept payment with Visa and Mastercard credit cards available in the UK, however We specifically do not accept American Express. Unless We agree to provide You with a credit account, subject to approval, You must pay for any products before We dispatch them. If credit terms are agreed by Us, payment in full shall be made within 30 days of the invoice date (unless otherwise agreed with You in writing).   

What to do if You think an invoice is wrong. If You think an invoice is wrong, please contact Us promptly to let Us know. You will not have to pay any interest until the dispute is resolved. Once the dispute is resolved We will charge You interest on correctly invoiced sums from the original due date.  

Set-off.  All amounts due to Us under these terms in full without any set-off, counterclaim, deduction or withholding) other than any deduction or withholding of tax as required by law).  

 5.     Delivery  

Delivery Costs.  The cost of delivery will be as displayed to You on Our website (or as discussed with You following an enquiry).   We shall deliver the products to the location indicated by You when You placed the order.   Delivery shall be completed on the completion of unloading of the products at Your delivery location.  

Mainland UK over £75.  Delivery of orders valued over £75 excluding VAT is free of charge to most parts of the UK.  There are some exceptions as outlined in clause 2, where standard delivery charges or free delivery will not apply. 

Oversized products which require a pallet delivery, or crane/Hiab offload may also incur an additional charge. If pallet delivery is not acceptable at the delivery address, YOU must explicitly state this and inform Us in the delivery instructions at the outset of the Order. 

Mainland UK under £75.  Delivery of most orders under £75 excluding VAT will be charged at £6.95 plus VAT for standard delivery, but such delivery charges are subject to change, so You are directed to the delivery page. 

Larger consignments and items may carry an additional charge for delivery. We will always confirm the delivery charges before accepting Your order. 

Delivery of Your order to Your premises.  Wherever possible, delivery will be made Monday to Friday between 08:30-18:00 and will be made to ground floor, kerbside only (unless previously agreed in writing).  Standard delivery is not always timed delivery.  You or an authorised person must be available to sign for Your delivery.  Failed attempts at delivery may result in additional re-delivery charges.  Leaving products without a signature is entirely at Your own risk. A delivery note will be provided.  

We expect You to inspect Your package before immediately signing and sign accordingly as ‘damaged package’ if it is not received in satisfactory condition.  We also expect You to check Your order on receipt and inform US immediately of any damages or missing items.  We cannot be held responsible for any damages or breakages after the products have been signed for if the order was signed for as being in good condition. 

Estimated delivery times.  During the order process We will let You know when We will provide the products to You.  Most items are despatched by standard delivery ( being next day) following acceptance of Your order. You are directed to the delivery page for specific delivery times.  Due to the items being despatched from multiple locations and some of Our products having longer delivery times, Your products may arrive in different packages and with different carriers, at no additional cost to You.   Stock levels may vary on a daily basis but We will always attempt to despatch Your item as soon as possible and will inform You if there is a significant delay expected on Your order 

Whilst We make every effort to deliver Your products to You as quickly as possible, the very latest delivery will take place within 30 days after the day on which We accept Your order (unless stated on the website or informed to You by Our customer representatives). 

We are not responsible for delays outside Our control.  If Our supply of the products is delayed by an event outside Our control then We will contact You as soon as possible to let You know and We will take steps to minimise the effect of the delay.  Provided We do this We will not be liable for delays caused by the event, but if there is a risk of substantial delay You may contact Us to end the contract and receive a refund for any products You have paid for but not received.  

Urgent Orders.  Please contact Our product sales team on 02920851000 (Opt 2) if Your order is required urgently and We will do Our best to meet Your deadlines.  

6.     Returns Refunds and Cancellation Policy 

We want You to be entirely happy with Your purchase from Us.  If You decide that the products are unsuitable for any reason You may cancel Your order, subject to Our terms, prior to shipping or within 14 days of delivery.  Notification of cancellation must be in writing, either by email to directcustomerservice@phs.co.uk or by letter which requires a signature on delivery, to PHS, Block B, Western Industrial Estate, Caerphilly, United Kingdom, CF83 1XH

Any other form of notification will not be valid. 

Upon receipt of Your written cancellation request we will confirm whether your order has been cancelled.  The products must be in their original packaging, unused, suitable for resale and suitably packed to ensure their safe return. You may be responsible for the cost of return carriage unless the goods are faulty or incorrect.  We will not provide refunds or accept returns of any products which are returned independently. Certain items may be excluded from cancellation rights under Consumer law, including personalised or special request products, (non-stocked or special request lines) and sealed goods that are not suitable for return once opened (for hygiene health or re-sell purposes) or liability for any products received at Our premises, where Our returns procedure has not been followed. 

If you are purchasing as a consumer, you have a statutory right to cancel your Order within 14 days of receiving your goods. You do not need to provide a reason for cancelling during this period. 

Refunds 
Where a cancellation notice is provided in accordance with this clause 6 we will issue a full refund for the price paid for the goods, including standard delivery charges, within 14 days or receiving your cancellation notice ( or the returned goods, whichever is the later) Refunds will be made using the original payment method, unless otherwise agreed. 

Our Commitment  
If you have any questions or concerns about your order our team is here to help. We aim to handle all cancellations and returns fairly, promptly and with care, ensuring You feel supported at every step. 

Excluded products are non-stock or special request lines.  

7.  Damaged Products 

Customers are expected to examine the products on receipt and report any damages or shortages straight away.  For damaged/faulty products please notify Us, preferably by email directcustomerservice@phs.co.uk or by using the contact us form on our website and We will forward a returns form for more information.  Please complete the returns form as soon as possible and return it to Us.  We will begin to look into the problem straight away. Nothing in these terms or Company policy affects your statutory rights under the Consumer Rights Act 2015. If goods are faulty, damaged, or not as described, you are entitled to a repair, replacement or refund, depending on the circumstances. 

All products, except for consumables, supplied byUs carry a 12-month minimum guarantee, some have up to 10 years guarantee supplied by the manufacturer.  Please see the description of the item for the exact length of guarantee offered for individual products. 

Standard Product Dispensers 

It is advised that only PHS consumable products (covered under warranty) should be used with Our product dispensers, for example, soap, hand towels, centre feed, mini and jumbo toilet roll and in such circumstances of normal wear and tear, the dispensers may be replaced at the discretion of PHS, however where product dispensers are found to be defective due to vandalism or circumstances beyond our control we shall not replace or be liable for such defective products. 

We shall not replace or be liable for defective product dispensers in situations where: 

(a)   The defect arises because You failed to follow our oral or written instructions as to storage, use or maintenance of the product 

(b)   You alter or repair such products without our guidance/consent 

(c)   The defect arises because of wilful damage, negligence or abnormal working conditions 

 8.   Risk / Title 

Risk. The risk in the products shall pass to You on completion of delivery and You shall be responsible for them from that point onwards. 

Title. Title to the products shall not pass to You until Wereceive cleared payment in full for the products, in which case title to the products shall pass at the time of payment of all such sums 

9.    Warranty  

We warrant that on delivery, and for a period of 12 months from the date of delivery (warranty period), the products (other than consumables) shall:  

          (a) conform in all material respects with their description.  

          (b) be free from material defects in design, material and workmanship. 

Where products are found to be defective within their warranty period, We shall, at Our option, repair, or replace the defective products free of charge or refund the price of the defective products in full provided that: 

          (a) You have given Us notice in writing during the warranty period within a reasonable time of discovery that some or all of the products do not comply with the warranty set out above. 

          (b) You have given Us a reasonable opportunity of examining  such products; and 

           (c) You (if asked to do so by Us) return such products to Our place of business at Our cost. 

Manufacturers may provide You with a longer warranty period.  Please see product description for details.  

 

10.  Limit of Liability.  Your attention is particularly drawn to this clause.  

We have obtained insurance cover in respect of Our own legal liability for individual claims not exceeding £10,000,000 per claim.  The limits and exclusions in this clause reflect the insurance cover We have been able to arrange, and You are responsible for making arrangements for the insurance of any excess loss. 

Nothing in these terms attempts to limit or exclude Our liability which cannot be legally limited, including but not limited for: 

(a)   Death or personal injury caused by Our negligence, or the negligence of Our employees and subcontractors or agents. 

(b)   Fraud or fraudulent misrepresentation. 

(c)   Breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession). 

Subject to the above clause, Our total liability to You shall not exceed an amount equal to the value paid for products actually supplied in any order. Our total liability includes liability in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract.  

The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and the terms implied by the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the contract. 

This clause 10 shall survive termination of these terms.  

11.   Events Outside of Our Control 

Wewill not be liable for any delay or failure to perform Our obligations resulting from circumstances outside of Our reasonable control, including, but not limited to, war, riot, terrorism, sabotage, strikes lockouts, accidents, acts of God, plant or machinery failure or shortage of raw materials. 

12.   Intellectual Property Rights / Copyright 

No use, copying or distribution of images text or information contained in Our website will be permitted without express permission and written consent of the copyright owner.  No ownership of any trademarks or rights of intellectual property will be transferred or affected by display of material or purchase of related goods.  

13.   Data Protection 

When ordering You will be required to supply the company with names, addresses and other details relevant to Your payment method and delivery.   We respect Your right to privacy of Your personal information. The information provided to Us will be used solely for the purpose of enabling the purchase and delivery of Our range of products. We will pass Your name, address and telephone number to the supplier, for Your delivery note, and Your email/telephone number to the courier delivering Your goods, for the purposes of ensuring that You receive Your order efficiently.   We will never pass Your information to other third parties. 

The Company may make contact about similar products and services that the Company offers. To stop receiving this information, please follow the link to unsubscribe, which is located in the footer of our marketing communications.

14.    Termination 

Termination or expiry of these Terms shall not affect any rights, remedies, obligations and liabilities of the parties that have accrued up to the date of termination or expiry, including the right to claim damages in respect of any breach of the Contract which existed at or before the date of termination or expiry. 

Any provision of these Terms that expressly or by implication is intended to have effect after termination or expiry shall continue in full force and effect. 

15.   General Notices Any notice given to a party under or in connection with these terms shall be in writing and shall be sent by email to the following email address customersupport@phs.co.uk or 

delivered by hand or by pre-paid first-class post or other next working day delivery service at its registered office (if a company) or its principal place of business 

Third Party Rights.  The contract is between Us and You.  No other person shall have any rights to enforce the terms of the contract by virtue of the Contracts (Rights of Third Parties) Act 1999. 

Assignment.  Wemay transfer Our rights and obligations under these terms to another organisation.  If this happens You will always be informed in writing and it will not affect Your rights under the contract or the obligations owed by You under the contract. 

You may only transfer Your rights and obligation under these terms to another person, if We agree in writing in advance.   

Waiver.  Failure or delay by Us to insist that You perform all of Your obligations, or to enforce Our rights, under these terms, does not indicate that We have waived Our rights and does not mean that You do not have to comply with Your obligations.  

Severance. If any provision or part-provision of these terms becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these terms. 

No Partnership.  Nothing in these terms is intended to, or shall be deemed to, establish any partnership or joint venture between the parties, constitute either party the agent of the other, or authorise either party to make or enter into any commitments for or on behalf of the other party. 

Promotions. Any Promotions made available through the PHS Shop may be governed by rules that are separate from these Terms. If You participate in any Promotions. Please review the applicable rules as well as Our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules apply. 

Working Days.  The term "Working days" excludes weekends and public holidays when banks in London would usually be closed for business. 

English language.  If these terms are translated into any language other than English, the English language version shall prevail in event of a conflict.  

Governing Law.  These terms are governed by the laws of England and Wales and We agree to submit to the exclusive jurisdiction of the English and Welsh courts.

New PHS Shop Launch Offer – Terms & Conditions (“Offer T&Cs”)

1.    This promotional offer (“the Offer”) is made by PERSONNEL HYGIENE SERVICES LIMITED (“we/us/our”). The Offer is non-transferable and may only be used by the business entity placing the order (“you/your”).

2.    The Offer provides a 15% discount on selected products purchased via the PHS online shop.

3.    The Offer applies to new purchases only and is available for orders placed during the Offer Period.

4.    The Offer is valid from 22/06/2026 to 19/07/2026 (“Offer Period”).

5.    To redeem the Offer, you must place an order via the PHS online shop within the Offer Period and, where applicable, enter a valid promotional code at checkout.

6.    The 15% discount:

- applies to the standard listed price at the time of purchase;
- cannot be applied retrospectively; and
- has no cash alternative.

7.    The Offer:
- is limited to one use per customer;
- may not be combined with any other promotion, discount, or negotiated pricing unless agreed in writing.

11.    In the event of a conflict between these Offer T&Cs and the Shop T&Cs, these Offer T&Cs shall take precedence in relation to the discount only, and the Shop T&Cs shall govern all other matters.
